The Unsettled Rights of Tenants in Malaysia

This article emphasizes on the call for Landlords and Tenants in Malaysia to be governed under one singular, independent, and all-encompassing legislation instead of having the need to refer or rely on various other legislation of the country. Therefore, as consequence to the absence of the required legislation, the Landlords and Tenants are found prone to exploitation and illegitimacy as far as the contents of the Tenancy Agreements are concerned. The challenges continue to perpetuate over the Legal Counsels representing the parties. This article also introduces other legislations and recent case laws applicable to the Tenants and the Landlord. The legislation and Case Laws enumerated hereunder are those which, among others, often not known or contemplated by either the Landlord and the Tenant or the Legal Counsel representing them.
